1. Acceptance of Terms

By accessing and using Roomfluence ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Beta Program - Limited Liability

IMPORTANT: Roomfluence is currently in BETA TESTING. This is pre-release software provided for evaluation purposes. By participating in the beta, you explicitly acknowledge and agree:

• No Warranties: The Service is provided "AS-IS" with NO warranties of any kind, express or implied, including warranties of merchantability or fitness for a particular purpose
• Bugs and Errors: The Service may contain bugs, errors, incomplete features, or may not function as intended
• Data Loss: We are NOT responsible for any data loss, corruption, or unavailability during the beta period. You should maintain backup records of important information
• Changes Without Notice: We may modify, suspend, or discontinue any features at any time without prior notice
• No Liability: We shall not be liable for any damages, losses, or issues arising from your use of the beta Service
• Beta Benefits: Beta users receive full access to Pro features at no cost during the beta period as a thank you for testing and providing feedback

3. User Accounts

To use Roomfluence, you must:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Be at least 13 years of age
• Be responsible for all activity under your account

4. Acceptable Use

You agree NOT to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Upload malicious code or spam
• Impersonate others or provide false information
• Scrape or harvest data without permission

5. Content Ownership

Your Content: You retain all rights to the content you create on Roomfluence (collaborations, brands, notes, etc.). By using the Service, you grant us a license to store and display your content as necessary to provide the Service.

Our Content: The Roomfluence platform, design, code, and branding are owned by us and protected by copyright, trademark, and other laws.

6. Data Sharing in Collaborative Features

By using Roomfluence, you explicitly consent to the following data sharing:

• Brand Information: When you add a brand to "My Brands" with a website URL, the brand name, website, Instagram URL, and logo are automatically synced to the shared Collab Explorer database. This data becomes visible to all Roomfluence users to help the community discover collaboration opportunities.
• Product Information: When you create a collaboration with a product name, that product information may be synced to the Products explorer visible to all users.
• Domain-Based Deduplication: Brands with the same website domain are automatically merged to prevent duplicates in the explorer.
• What Remains Private: Your personal collaboration details including pricing, payment terms, contracts, private notes, email communications, and deliverable tracking remain completely private to your account.

Important: Do not enter confidential or proprietary brand information into "My Brands" if you do not want it shared with the community. The collaborative explorer is designed to benefit all creators by building a shared knowledge base of brand opportunities.

7. Termination

We reserve the right to suspend or terminate your account if you violate these terms. You may also delete your account at any time through your account settings.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We explicitly disclaim all warranties, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• Uninterrupted, secure, or error-free operation of the Service
• Accuracy, reliability, or completeness of any content, calculations, or AI-generated content
• That the Service will meet your specific requirements or expectations
• The accuracy of brand information in the Collab Explorer
• The success or outcome of any brand partnerships or collaborations
• Data backup, persistence, or recovery

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• ROOMFLUENCE AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• This includes but is not limited to: loss of profits, data, use, goodwill, business opportunities, or other intangible losses
• We are not liable for any damages resulting from: (a) your use or inability to use the Service, (b) unauthorized access to your data, (c) bugs or errors in the Service, (d) any conduct of other users, (e) any content obtained from the Service
• Our total liability for any claims related to the Service shall not exceed $0 (zero dollars) during the beta period

Beta Testing Agreement: You acknowledge that you are participating in beta testing at your own risk and that we are not liable for any issues, damages, or losses that may occur.

10. Beta Pricing

Beta users receive lifetime free access to Pro features as a thank you for participating. This benefit is granted at our discretion and may have reasonable usage limits to prevent abuse.

11. Changes to Terms

We may modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the new terms. We will notify beta users of material changes via email.
